Can a parent travel internationally with his or her child without the permission of the other parent? Generally, the answer is no. One parent must obtain permission from the other parent before traveling across an international border. Another option would be to obtain a court order to allow international travel with a child.
At the Law Offices of Robert J. Tennant, we help parents understand the specifics of their child visitation and custody agreements following divorce. If you are looking to travel outside the country with your child, or if you wish to object to the other parent taking your child outside of the U.S., contact our law office to learn about your legal options.
The Issue of International Abductions
One parent taking his or her child outside of the United States without the permission of the other parent is considered kidnapping. Recent high-profile cases have brought attention to this issue, putting it on the radar of state lawmakers to protect children.
Parents have a better chance of traveling internationally with their child if their destination is a Hague Convention country. The Hague Convention is an international treaty that was established to address the issue of increased international child abductions, among other issues. If the destination country has adopted the Hague Convention, there is a better chance that the courts of both countries will cooperate in aiding in the return of the child, if the apparent motive is abduction.
